Mob Crew Terms of Service

By accessing or using the Mob Crew website (the "Site") or any services provided by Mob Crew (the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Mob Crew. By accessing the Site or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access the Site or use the Services.

Mob Crew offers freshly roasted coffee beans, roasted to order, and a variety of merchandise that is created or printed to order. Our Services include the processing of orders, the roasting and creation of goods, and the arrangement of shipping to your designated address.

3. User Accounts

You may be required to create an account to access certain features of the Site or use certain Services. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to accept responsibility for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Mob Crew reserves the right to suspend or terminate your account if any information provided is inaccurate, incomplete, or misleading, or if your use of the Services violates these Terms.

4. Ordering and Payment

  • By placing an order through our Site, you are offering to purchase products based on the terms and conditions outlined herein.
  • All orders are subject to acceptance by Mob Crew. We may refuse to accept or may cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product descriptions, or suspicion of fraudulent activity.
  • Prices for our products are subject to change without notice.
  • You agree to pay the full price for the products you purchase and any applicable shipping fees. Payment must be made through the payment methods offered on the Site.
  • You represent and warrant that you are authorized to use the payment method you provide.

5. Shipping and Delivery

Our Shipping Policy, which is incorporated into these Terms by reference, outlines our processing and shipping procedures. As stated in our Shipping Policy, while we strive to process and ship orders promptly (coffee roasted within 48 hours, merchandise created within 48 hours), Mob Crew is not responsible for any delays in shipping caused by unforeseen circumstances or issues with the shipping carrier.

6. Returns and Refunds

7. Intellectual Property

  • The Mob Crew name and logo are trademarks of Mob Crew. You may not use these trademarks without our prior written consent.

8. User Content

  • You may be permitted to submit content to the Site, such as reviews or comments ("User Content"). You retain ownership of your User Content.
  • By submitting User Content, you grant Mob Crew a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
  • You represent and warrant that you have all necessary rights to grant the licenses in this section and that your User Content does not violate any third-party rights or applicable laws.

MOB CREW DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY RELIANCE ON THE SITE OR SERVICES IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOB CREW, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF MOB CREW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL MOB CREW'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE AMOUNT YOU PAID TO MOB CREW FOR THE APPLICABLE PRODUCTS OR SERVICES.

You agree to indemnify, defend, and hold harmless Mob Crew, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Site or Services, your User Content, your violation of these Terms, or your violation of any rights of another party.
